Terms of Service and Sale

These Terms govern use of the DNASKATE website and purchases from the DNASKATE online store. By placing an order, you agree to these Terms and the policies incorporated by reference. Nothing in these Terms excludes or restricts rights that cannot lawfully be waived.

1. Store Operator and Contact

2. Eligibility and Account Information

You must have legal capacity to enter into a contract or have authorization from a parent or legal guardian. You must provide accurate order, contact, delivery, and payment information and keep account credentials secure.

3. Product Information

We take reasonable steps to describe products accurately. Display colours, packaging, or minor product details may vary. Material specifications, compatibility, battery information, and safety instructions shown for the selected variant form part of the product information. We may correct an obvious error, but we will not make a material adverse change to an accepted consumer order without contacting the customer and providing any remedy required by law.

4. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean acceptance. The contract is formed when we expressly accept the order or dispatch the goods, subject to applicable law. We may decline an order for genuine reasons such as unavailable stock, payment failure, suspected fraud, pricing error, legal restriction, dangerous-goods route restriction, or inability to deliver. If payment was taken for a declined order, it will be refunded.

5. Prices, Payment and Taxes

The total price and any shipping charges, taxes, or fees collected by DNASKATE are displayed before the customer places the order. Payment must be authorized by the account holder. We may use payment providers and reasonable fraud-prevention checks. We will not add an undisclosed charge after checkout.

6. Shipping, Delivery and Risk

Processing times, routes, estimates, tracking, and destination restrictions are described in the Shipping and Delivery Policy. For consumer orders using a carrier selected by DNASKATE, risk remains with DNASKATE until the customer or the customer's designated third party acquires physical possession, except where applicable law provides otherwise.

7. Withdrawal, Returns and Refunds

Withdrawal, return, refund, cancellation, and exchange rules are set out in the Return, Withdrawal and Refund Policy. Mandatory consumer rights take priority over any inconsistent commercial condition. In particular, eligible EU/EEA and UK consumers may have a statutory 14-day right to withdraw from an online purchase without giving a reason.

8. Conformity, Legal Guarantees and Warranty

Goods must conform to the contract and applicable law. Consumers may have mandatory rights to repair, replacement, price reduction, or refund when goods are faulty, unsafe, or not as described. Any commercial warranty is additional to, and does not replace, mandatory legal guarantees.

9. Product Safety and Lawful Use

Electric skateboards involve fall, traffic, fire, and lithium-battery risks. Follow the manual, wear appropriate protective equipment, observe rider limits, use the correct charger, inspect the product before use, and comply with local laws governing where and how the product may be ridden. Stop using or charging a product if the battery is damaged, swollen, leaking, unusually hot, or exposed to water. Safety instructions do not exclude liability that cannot lawfully be excluded.

10. Intellectual Property

Website content, branding, product media, manuals, and software are owned by or licensed to DNASKATE and protected by applicable intellectual-property laws. You may use the website and purchased product materials for personal, lawful purposes. You may not copy, sell, scrape, reverse engineer, or commercially exploit protected content except where applicable law permits.

11. Reviews and User Content

If you submit a review, image, or other content, you confirm that it is accurate, lawful, and does not infringe another person's rights. You grant DNASKATE a non-exclusive, worldwide, royalty-free license to display and use that content for operating and promoting the store. This license does not transfer ownership and is subject to applicable privacy and consumer law.

12. Prohibited Conduct

You may not use the website for fraud, unlawful activity, interference with security, distribution of malware, infringement of rights, harassment, unauthorized data collection, or attempts to disrupt the service. Reasonable automated access must comply with applicable law, published technical controls, and any permission we provide.

13. Third-Party Services

The store uses Shopify and may link to payment, carrier, social-media, or other third-party services. Those services may have separate terms and privacy notices. DNASKATE remains responsible for the sales contract to the extent required by law.

14. Availability and Disclaimers

We aim to keep the website available and accurate but do not guarantee uninterrupted operation. To the maximum extent permitted by law, implied warranties relating solely to website access are excluded. These exclusions do not apply to mandatory product conformity, safety, consumer, or other non-excludable rights.

15. Liability

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory product-safety obligations, or any liability that cannot legally be limited. Subject to those exceptions, DNASKATE is not liable for indirect or unforeseeable business losses suffered by a consumer. Consumers remain entitled to compensation and remedies required by applicable law.

16. Indemnity

Business users agree to indemnify DNASKATE for third-party claims arising directly from their unlawful misuse of the service or infringement of another person's rights. This section does not apply to consumers to the extent prohibited by law.

17. Changes

We may update these Terms prospectively for legal, security, operational, or service reasons. The version applicable to an order is the version made available when that order was placed, unless a change is required by law or the customer expressly agrees otherwise.

18. Governing Law and Consumer Protections

Subject to mandatory conflict-of-law rules, these Terms are governed by the law applicable to the DNASKATE store operator. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your habitual residence where those protections apply. Nothing in these Terms requires a consumer to bring a claim exclusively in Hong Kong if applicable consumer-jurisdiction rules allow the claim elsewhere.

19. Severability

If a provision is unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions continue to apply.
